Eight spectators who came to watch a popular off-road race were killed in Lucerne Valley in the Mojave Desert outside Victorville. More than a dozen spectators sustained serious injuries in this tragic truck crash. The racing accident occurred soon after the race started when a participating truck lost control and plowed into the spectators. The 200-mile race involved a variety of off-road vehicles scheduled to race 100 miles northeast of Los Angeles.

Seven of the spectators who were killed in this fatal crash were identified as Brian Wolfin, 27, of Escondido; Aaron Farkas, 25, of Escondido; Andrew Therrin, 22, of Riverside; Zachary Freeman, 24, of Fillmore; Danica Frantzich, 20, of Las Vegas; and Dustin C. Malcos, 24, of Ventura. The name of the eighth victim has not been released by the authorities yet.

Were the authorities ready for such a mishap? Was the safety of viewers kept on mind? Was driving ability of participants checked? These and several more questions that remain unanswered. Two people sustained serious injuries in a car crash at the J.J. Bakery in the 2300 block of Crenshaw Boulevard on June 18, 2010. According to the news report published in the Daily Breeze, a woman was parking her Mercedes Benz in front of the J.J. Bakery when she hit the gas instead of the brakes and struck the front door.

A person standing close to the cash register was pinned against the cooler placed in the bakery and the cashier was pinned between the back wall and the cash counter.  Both the injured victims suffered serious bone injuries and were transported to a nearby hospital for treatment.

Two people sustained critical injuries and several others were also injured in a Los Angeles car crash after a tour bus collided with another vehicle head on. According to the Pasadena Star News report, this auto accident occurred on June 17, 2010, near the intersection of Garvey Avenue and San Gabriel Boulevard when a Nissan Sentra was rear ended by a Honda Civic.

The impact pushed the Nissan right in the lane of oncoming traffic and lead to a head-on collision with a tour bus. According to a news report, 20 passengers travelling in the tour bus sustained minor non-catastrophic injuries. Drivers of both the vehicles were taken to a nearby hospital with critical injuries.

The tour bus belonged to the US Asia tour bus company and was heading towards a casino. A car crash on May 19, 2010, injured four people when a car turned over on Interstate 80 (I-80) in Dixon. According to the California Highway Patrol, Shelbee Szeto, 18-years old of Oakland, was driving his Mazda Sedan westbound when he lost control of his vehicle.  The auto accident happened at about 10 a.m.

The auto wreck occurred near the Highway 113 exit when his vehicle went out of control and started to roll over. The Mazda sedan landed upside down on an embankment along the freeway’s shoulder.

Szeto, along with three others sustained minor injuries. As reported by the California Highway Patrol, Fion Wong of Davis, 19, Sandra Ho, 20 and Bonnie So, 18, suffered injuries. The California Highway Patrol is still investigating the cause of the car crash.

A 21-year old drunk Marina resident injured two Monterey police officers in a Monterey DUI car accident that took place on March 25, 2010 on Fremont Street at around 1:00 am.

Cory Overton, the drunk driver, was driving his 2000 Dodge Dakota towards the Abrego Street Station when he collided head-on with the Monterey Patrol car. Reportedly, Overton crossed the yellow lines and crashed into the oncoming patrol vehicle. The two police officers were taken to a nearby hospital where they were treated for upper back, head pain, and neck injuries. The Real World: San Francisco star David Rainey (otherwise known as “Puck”) was arrested for drunk driving in a San Diego injury accident that took place on March 24, 2010 on California’s Route 79. Rainey’s 8-year-old son was also injured along with him in the car accident.

Rainey was of for a fishing trip when he swerved his car to avoid hitting a deer but lost control and the car rolled down an embankment and rested upside down in the stream bed. An off-duty Orange County Sheriff’s Deputy was arrested on suspicion of DUI after he crashed his Mercedes-Benz into another vehicle and injured a passenger. Deputy Allan James Waters had crashed his vehicle half an hour before outside City Hall in Dana Point but was allowed to drive away.

About 30 minutes later, at 5:20 p.m., Waters crashed his Mercedes-Benz into a Toyota in Laguna Niguel, causing it to cross the center median and slam into a tree, according to the California Highway Patrol. The 78-year old Toyota passenger, Dolores Molina, suffered minor injuries.

The Sheriff’s Department is conducting an internal investigation to determine why Waters was allowed to keep driving. He will remain on leave while the investigations are conducted. Each personal injury case is different and requires its’ own evaluation and skills to maximize the value of the claim.  However, when you find yourself against Allstate, you can typically assume that you will need to hire an experienced and aggressive personal injury trial attorney to assist you.  This belief is based upon dozens of cases against Allstate’s in-house lawyers and adjustors.

A recent auto vs. pedestrian accident case result serves as a good example.  Our office represented a young woman who was struck and injured while she was exiting her car in a parking lot and was pinned in the open rear door of her car after the other driver, an Allstate insured driver, accelerated unexpectedly and struck three cars so hard that the third car was pushed three feet until it slammed into the open rear door of our client’s vehicle.

By that time, we were just three months from trial and our client’s medical bills had increased to nearly $30,000.  In an effort to try to resolve the case without going to trial, we attended a mediation and made a demand of $100,000 which was the other driver’s insurance policy limit.  Allstate increased their offer to $6,500.

Allstate was not disputing that their driver was negligent.  They would admit that their driver screwed up and that they should pay for the damages their driver caused.  They disputed what those damages were and their value.  However, their position was unreasonable and would not be supported by anyone at trial except their independent medical examiner.

We deposed the independent medical examiner shortly before trial.  Unlike Allstate, his position was reasonable and largely supported our client.  He testified that our client suffered from a chronic neck injury and that almost all of her medical care was reasonable and necessary for her care.  His position–which did not meet the facts–was that she should not undergo the denervation procedure.  She should just manage her pain the rest of her life.

The fact of the matter was that, before trial, our client did undergo the denervation and it was successful.

Shortly before trial, Allstate finally agreed to pay the $100,000 settlement demand.  They had fought tremendously to delay and deny our client for nearly three years since the date of injury.  But now, after we had done our best to take away any excuse and defense–no matter how ridiculous–so that they had no choice but pay the reasonable settlement demand.

A young girl from the Inland Empire city of Corona died last week when the SUV she had been traveling in rolled over while driving along the Interstate 15, a popular stretch that has a large presence in San Diego and travels northward and eastward through Riverside and San Bernardino Counties towards Nevada and Las Vegas. The girl was 16 years old.

The Riverside County coroner’s office identified the victim as Alexis Victoria Vega.  She died at the scene of the accident, which took place north of Limonite Avenue on southbound Interstate 15 on August 14, 2009.

While the accident is still under investigation, the CHP noted that Joshua Daugherty, 19, of Corona, drove onto the dirt shoulder and veered back to the freeway at much too fast a speed. The SUV then spun and hit a metal call box before overturning, sliding on its side and rolling onto the roof. Daugherty, along with front-seat passenger Issac Ball, 18, of Corona, were able to exit the vehicle, but Vega was trapped in the back seat.

A popular Christian band called MercyMe canceled a show from their summer tour in St. Louis after their tour bus collided with a vehicle in northeastern Indiana, leaving two passengers dead, including the pregnant driver’s unborn baby.

None of the band members was seriously injured and only suffered “minor bumps and bruises”.  A news story on the bus crash and a photo of the damaged front end of the bus were put up on the band’s Web site last Saturday.

According to a police officer from Fort Wayne, Indiana, witnesses reported that the bus had been going through a green light at 1:15 a.m. when the car made a left-hand turn in front of it. The Dallas-based band had been in the midwest for a concert on August 14.

Unfortunately, two passengers in the car, a male and a female, were pronounced dead. The driver, Kara Klinker, 18 of Fort Wayne, was in the third trimester of her pregnancy and lost her baby. Klinker was hospitalized  in critical condition. The names of the other victims had not yet been released pending notification of their families.
