Wrongful Death Lawsuit Filed by Survivor of Fatal Fresno Truck Accident

Date: August 3, 2009

Location: Oakland and Lassen, near Five Points, Fresno County, CA

Type: Hit-and-run commercial truck vs. car accident

Outcome: Four people killed, one person injured

Concepcion Lopez, the sole survivor of a hit-and-run car accident in Fresno County, has filed a lawsuit against truck driver Hernesto Escalante of Modesto and his employer.  Escalante was driving a commercial tomato truck when it crashed into the car carrying Lopez, her husband, and three other men.  The impact was so severe that it caused the Honda Civic that Lopez was travelling in to go underneath one of the trailers.  The four men were killed instantly, but Lopez survived.

Escalante is facing four counts of vehicular manslaughter and a charge for leaving the scene of an injury accident.

This is truly a tragic set of events, made all the worse by Escalante fleeing the scene.  Our prayers go out to the families of the victims and we hope that they can get the peace and compensation they deserve.
